1Parties & Agreement
These Terms & Conditions ("Terms") form a legally binding agreement between MCS LLP ("Company", "We", "Us") and the individual registering for or using our services ("Candidate", "User", "You"). These Terms govern all services offered by the Company including training programs, skill development, career guidance, interview preparation, and job placement assistance.
2Description of Services
The Company provides the following services on a best-effort basis:
- Professional and vocational training programs
- Skill development and soft skills enhancement sessions
- Resume preparation and career counselling
- Mock interviews and aptitude test preparation
- Job placement assistance and employer referral support
- HR consultancy and candidate screening for corporate clients
All services are provided for a fee. The fee is charged for access to the service, not for any guaranteed result or outcome. Services are subject to availability and may be modified or updated at the Company's discretion.
3No Job Guarantee — Important Clause
- Any job offer, interview call, or employment opportunity
- A specific salary, compensation package, or income level
- Placement within any particular timeframe or with any specific employer
- Selection by any industry, company, or recruiter
- Any number of interview opportunities or shortlisting frequency
Any verbal or written representation that contradicts this clause — whether made by any person affiliated with the Company or otherwise — shall be considered unauthorised and shall not be binding on the Company.
4Candidate Responsibilities
By registering and using our services, you agree to:
- Provide accurate, truthful, and complete personal and professional information at all times
- Notify the Company promptly of any changes to your registered information
- Keep login credentials confidential and not share account access with any third party
- Attend all scheduled training sessions, interviews, and orientations punctually
- Engage respectfully and professionally with trainers, counsellors, and employer representatives
- Follow all program guidelines, schedules, and instructions issued by the Company
- Not engage in conduct that disrupts the learning environment or other candidates
- Comply with all applicable laws and ethical standards while using our services
5Payment Terms
- All fees must be paid in advance before services commence, unless a written instalment agreement is in place.
- Fees are quoted inclusive of applicable taxes unless stated otherwise.
- Payments are non-refundable except under the specific conditions set out in our Refund Policy.
- The Company is not responsible for payment failures or delays arising from the candidate's bank, UPI provider, or device.
- Payment of the fee confirms the candidate's understanding that fees are for services rendered, not outcomes achieved.
6Prohibited Conduct & Misuse
The following actions are strictly prohibited and may result in immediate termination of services without refund, along with appropriate legal steps under applicable Indian law:
- Providing false, fabricated, or misleading information at any stage
- Sharing, copying, or distributing any proprietary course material without written consent
- Filing false or malicious complaints against the Company with consumer forums, authorities, or online platforms
- Attempting to misuse the refund or dispute mechanism dishonestly
- Impersonating another candidate or a Company representative
- Abusive, defamatory, threatening, or disruptive behaviour towards Company staff or other candidates
- Misrepresenting our services or terms to other candidates or the public
7Right to Suspend or Terminate Service
The Company reserves the right to suspend or permanently terminate a candidate's access to all services — without prior notice and without any refund obligation — in the event of:
- Any breach of these Terms & Conditions
- Persistent absenteeism, inactivity, or non-engagement with the program
- Misconduct or abusive behaviour towards Company staff or other candidates
- Detection of fraudulent registration or payment
- Legal complaints found to be baseless or made in bad faith
8Intellectual Property
All content provided by the Company — including training materials, videos, documents, templates, and assessments — is the exclusive intellectual property of MCS LLP and is protected under Indian law. Unauthorised reproduction, distribution, resale, or derivative use of any Company content is strictly prohibited.
9Limitation of Liability
MCS LLP shall not be liable for:
- Loss of income, employment opportunity, or salary as a result of using or not using our services
- Direct, indirect, incidental, consequential, or special damages of any nature
- Losses arising from technical failures, force majeure events, or third-party platform issues
- Actions or decisions made by hiring employers regarding any candidate
- Outcomes resulting from career guidance or counsellor advice
The Company's maximum aggregate liability under any claim shall not exceed the total fee amount actually paid by the candidate for the specific service in dispute.
10Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of India. All disputes shall be subject to the exclusive jurisdiction of competent courts at the registered location of MCS LLP. The parties agree to first attempt resolution through good-faith discussion, and if needed, through binding arbitration before approaching courts.
11Modifications to Terms
The Company may revise these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
